Terms of Service

1. Acceptance of Terms

By accessing or using InstaKYC (instakyc.in), operated by Oriel Inc., you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our platform. These terms constitute a legally binding agreement between you and Oriel Inc.

2. Description of Service

InstaKYC is a B2B KYC verification platform that provides document verification services including Aadhaar, PAN, Bank Account, Driving Licence, Voter ID, and Vehicle RC verification through authorized API integrations. The platform operates on a prepaid wallet model.

3. Eligibility

• You must be at least 18 years of age
• You must be a registered business entity or individual professional in India
• You must have a valid mobile number and email address
• You must not be prohibited from using such services under applicable law

4. Account Registration & Security

You are responsible for maintaining the confidentiality of your account credentials. You must immediately notify us of any unauthorized use of your account. InstaKYC will not be liable for any loss arising from unauthorized account access due to your negligence.

5. Permitted Use

You may use InstaKYC only for lawful KYC verification purposes. Permitted uses include:

• Customer onboarding and identity verification for your business
• Document verification for loan processing, account opening, or compliance
• Employee background verification

6. Prohibited Use

• Verifying individuals without their knowledge or consent
• Using verification data for surveillance, stalking, or harassment
• Reselling verification results to unauthorized third parties
• Attempting to reverse-engineer or scrape our platform
• Using the platform for any fraudulent or illegal purpose
• Storing or sharing Aadhaar data in violation of the Aadhaar Act 2016

7. Wallet & Payments

• All payments are prepaid and non-refundable except as stated in our Refund Policy
• Wallet balance has no cash value and cannot be transferred to other users
• Service charges are deducted per successful API call as per the published rate card
• InstaKYC reserves the right to modify service charges with 7 days notice
• Unused wallet balance will be refunded upon account closure, subject to our Refund Policy

8. Data Usage & Compliance

You agree to use verification data in compliance with all applicable laws including the Aadhaar Act 2016, IT Act 2000, DPDP Act 2023, and RBI KYC Guidelines. You are solely responsible for obtaining consent from individuals whose data you submit for verification.

9. Service Availability

InstaKYC strives to maintain 99% uptime but does not guarantee uninterrupted service. Downtime may occur due to maintenance, third-party API issues, or circumstances beyond our control. Credits will not be issued for downtime unless caused by our verified system failure.

10. Limitation of Liability

InstaKYC's total liability to you for any claim shall not exceed the amount paid by you in the 30 days preceding the claim. We are not liable for indirect, incidental, or consequential damages. Verification results are provided "as-is" based on government database responses; we do not guarantee their accuracy.

11. Termination

We reserve the right to suspend or terminate your account without notice if you violate these Terms. You may close your account at any time by contacting support@instakyc.in.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Gurugram, Haryana.
