InstaKYC provides document verification services by querying government databases through authorized API providers. The accuracy of results depends entirely on the data available in those government systems. InstaKYC:

• Does not guarantee the accuracy, completeness, or timeliness of verification results
• Is not responsible for errors in government databases or API provider systems
• Does not independently verify or validate the authenticity of documents
• Cannot be held liable for decisions made based on verification results

2. Not a Legal or Compliance Service

InstaKYC is a technology platform providing data verification tools. It is not a legal service, compliance advisory, or regulated financial service. Businesses using InstaKYC for compliance purposes must ensure they meet all applicable regulatory requirements independently. InstaKYC does not provide legal, financial, or regulatory advice.

3. Aadhaar-Based Verification

Aadhaar-based verification is provided in compliance with the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act 2016 and UIDAI regulations. Users must:

• Obtain explicit consent from individuals before performing Aadhaar verification
• Not store Aadhaar numbers in full — only masked versions are permitted
• Use Aadhaar verification only for permitted purposes under law
• Comply with all UIDAI guidelines applicable to their use case

4. Third-Party API Dependency

InstaKYC relies on third-party API providers (including Surepass Technologies) for verification data. Service availability, response accuracy, and data freshness are subject to these providers' systems. InstaKYC is not liable for service interruptions, data errors, or delays caused by third-party systems.

5. No Warranty

The InstaKYC platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be error-free, uninterrupted, or free from viruses or other harmful components.

6. User Responsibility

You are solely responsible for:

• Ensuring lawful use of verification results
• Obtaining required consents from data subjects
• Complying with applicable data protection and KYC laws
• Securing your account credentials and API tokens
• Any decisions made based on verification results from our platform

7. Limitation of Liability

To the maximum extent permitted by applicable law, Oriel Inc. and InstaKYC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, business interruption, or financial loss.

8. Indemnification

You agree to indemnify and hold harmless Oriel Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of InstaKYC or violation of these terms.

9. Regulatory Compliance Notice

InstaKYC operates as a technology service provider and is not regulated by RBI, SEBI, IRDAI, or any other financial regulator. Businesses in regulated sectors must ensure InstaKYC's use is compliant with their specific regulatory requirements.
